KOTA KINABALU – The court has dismissed the election petition filed against the decision of the State Assembly (DUN) N.35 Sindumin.
The petition submitted by Wendy Agong Baruh has been completely dismissed. In its decision, the court also ordered the petitioner to pay costs of RM20,000 to each respondent, involving a total of three parties.
The first respondent is Mr. Abdul Karim as the Election Manager, while the second respondent is the Election Commission of Malaysia. Both of them are represented by officers from the Attorney General's Office. The third respondent, Yusri Pungut, represents himself and he is also a Senior Lawyer in Sabah.
The court in its judgment emphasized that the previously gazetted election results are valid and remain. With this decision, YB Yusri Pungut remains the legitimate representative for DUN N.35 Sindumin as previously announced and gazetted.
The decision thus concludes the proceedings of the election petition and confirms the official position of the representative for the area.
